          Do not just walk away from your deposit without contacting us.   Whether your project is registered with HUD or not, it is likely that we can recover all or some of your deposit.   The developer is counting on you to just walk.   He is counting on you to believe the contract is probably  "ironclad."   Don't do it!  Most real estate lawyers claim to be familiar with the Florida Condominium Act and ILSA (the federal Interstate Land Sales Full Disclosure Act) and they will gladly review your contract (usually for a healthy fee).   But, unless they specialize in this field, it is unlikely that they will be aware of all of the issues that can be raised. 

          Whether you are considering not closing on your investment or you have already "walked away" from your deposit, it is likely we can recover at least some of your deposit.   Yes, even if you have already defaulted - and even if the 20 day period to "cure" your default has come and gone -  do not think it's a lost cause.   Contact us.   It costs nothing.    As a purchaser of real estate, you should contact us immediately.   We will assist you in your attempt to recover your deposit and/or cancel your real estate contract.  

         Although the developers prefer to portray the scenario as greedy investors simply wanting to back out of a deal gone sour, we have seen all too many instances of developer fraud and misrepresentation and violations of both ILSA and Florida Condominium Law.   We see developers even violating provisions of their own contract which require them to  return certain moneys to the buyer even if the buyer has breached the contract.   Not surprisingly, most developers simply take the attitude of  "So sue me."   Many investors don't realize that they may be able to get the developer to pay their legal fees in addition to recovering some or all of their deposit.
